General Terms and Conditions of Return from Merchandise

These General Conditions of Return define the terms and conditions under which you, as a customer, may return the purchased products to [Nom de l'entreprise] and the obligations arising therefrom. These conditions apply to all orders placed on our website, by telephone or by any other means. We encourage you to read these conditions carefully before making a purchase. By placing an order, you accept these conditions without reservation.


1. Right of withdrawal (Online and Offline Sales)

1.1. Perimeter of the Right of Withdrawal

The right of withdrawal applies only to distance purchases (internet, telephone, catalogue) and off-site sales (such as home or market sales). It does not apply to in-store purchases unless otherwise provided by the store.

1.2. Time limit for withdrawal

You have fourteen (14) days from receipt of your order to exercise your right of withdrawal. This period is considered to be met if you send your request for withdrawal before the expiry of that period.

1.3. Notification of withdrawal

To exercise your right of withdrawal, you must notify your decision by a clear and unambiguous declaration. This must be done by, e-mail. Here is the contact information for withdrawal:

1.4. Effects of Withdrawal

In the event of withdrawal, we will reimburse you for all payments, including initial delivery costs (except for additional costs resulting from the choice of a delivery method other than the cheapest standard mode proposed by us), without undue delay and not later than fourteen (14) days from the day we have been informed of your withdrawal decision. The refund will be made by the same means of payment as used in the initial transaction, unless you agree otherwise.


2. Products Excluded from the Right of Withdrawal

Certain products may not be subject to a right of withdrawal, including:

  • Perishable products Any product likely to deteriorate or perish rapidly (e.g. food, flowers, etc.).
  • Hygiene products : Sealed goods which cannot be returned for reasons of health protection or hygiene and which have been unsealed after delivery (e.g. underwear, cosmetics, etc.).
  • Customised products : Any product made according to consumer specifications or clearly customized (such as custom clothing, engraved jewellery, etc.).
  • Records and Software : Audio, video or computer software records unsealed after delivery.

3. Conditions for Acceptance of Returns

3.1. Status of Returned Products

To be eligible for a return, products must be returned in a condition proper to resale, i.e.:

  • Not used, not damaged, and not washed.
  • With all original accessories, labels, and instructions included.
  • In their original packaging in good condition (the careful opening of the packaging does not render the product unfit for resale).

3.2. Products Not Conform or Defective

In the event of receipt of a product that does not conform to your order or is defective, you must inform us as soon as possible (and no later than 7 days after receipt) in order to arrange a free return or exchange. After inspection of the returned product, we will offer you either a replacement or a full refund, including delivery costs.


4. Return procedure

4.1. Obtaining a Return Number (RMA)

Before returning a product, you must obtain a return number (RMA) by contacting our customer service. Returns without a valid return number may be refused. Here is how to proceed:

  2. Enter your order number, the product(s) you wish to return, and the reason for your return.
  3. A return number (RMA) will be assigned to you and detailed return instructions will be provided.

4.2. Packaging and Shipping

The product must be carefully packed to avoid damage during transport. We recommend that you reuse the original packaging and properly protect the product. You are responsible for the damage suffered by the product when it is returned if it is mispacked.

4.3. Return time

The products must be returned within fourteen (14) days after you have communicated your withdrawal decision. After this period, we reserve the right to refuse return.


5. Return costs

5.1. Costs to the Customer

Except in case of defective product or error on our part, the return costs are at your expense. You can choose the carrier of your choice, but it is strongly recommended to use a delivery service with tracking to avoid any loss.

5.2. Liability for loss or damage

You are responsible for the product until it is received by our services. In the event of loss or damage during return transport, we reserve the right to refuse reimbursement or deduct an amount corresponding to the damage suffered.


6. Refund

6.1. Method of reimbursement

After receipt and verification of the returned product, we will make the refund. This refund will include the price of the returned product and, in some cases, the initial shipping costs. The refund will be made using the same method of payment as used in the initial transaction, unless otherwise expressly agreed.

6.2. Refund periods

We undertake to process refunds within fourteen (14) days of receipt of the returned product or proof of shipment of the product (the first of these facts being retained). However, delays may occur if the inspection of the product reveals non-compliance.


7. Exceptions to the Right of Withdrawal

7.1. Customized or Customized Products

Products made according to your specifications or customised cannot be retracted, unless there is a defect or non-compliance.

7.2. Deteriorating goods

Perishable or rapidly deteriorating products are not eligible for the right of withdrawal.

We reserve the right to amend these general conditions of return at any time. The applicable conditions are those in force at the time of your order, unless a legal or regulatory amendment requires that these conditions be updated.


10. Jurisdiction and Applicable Law

These general conditions of return are governed by French law. In the event of a dispute, the Courts of Lyon will have sole jurisdiction, subject to a specific attribution of jurisdiction arising from a particular law or regulation.
